These terms govern your use of the Seaside Delicatessen website and any orders you place with us, in the deli, by phone, or through this website. Please read them carefully.

01 Agreement to these terms

By using this website or placing an order with Seaside Delicatessen (“Seaside,” “we,” “us,” or “our”), you agree to these terms. If you do not agree, please do not use the website. Separate terms may apply to particular services, such as catering, and will be provided when you order.

02 Menu, prices, and availability

We update our menus regularly, but items, ingredients, portion sizes, and prices may change without notice and may differ from what is shown online. Seasonal and specialty items are available while supplies last.

Product photography is for illustration. Your order may look slightly different from the image shown. If we find a pricing error, we will contact you before preparing your order, and you may cancel without charge.

03 Placing orders

Orders may be placed at the counter or by phone. Phone orders are confirmed only when a member of our team has repeated the order back to you. Ready times are estimates, and orders not collected within 30 minutes of the agreed time may be discarded for food safety reasons.

We may decline or cancel an order, for example where an item is unavailable, the order cannot be fulfilled safely, or we suspect fraud. If you have already paid for a cancelled order, we will refund you in full.

04 Catering orders

Catering is subject to the lead times and minimums listed on our catering menu:

Hot and cold buffets must be ordered at least 5 days in advance and have 15–20 person minimums.
Hero orders require two days’ notice, excluding weekends and holidays.
A deposit is required for chafing racks and must be paid when you order. It is refunded when the racks are returned clean and undamaged.
Changes to guest counts or menu selections must be made at least 48 hours before collection. Cancellations within 48 hours may be charged in full.
Paper goods, serving utensils, and delivery are not included unless stated in your order confirmation.

05 Payment

All prices are in US dollars and exclude applicable sales tax unless stated otherwise. We accept major credit and debit cards, contactless payment, and cash in the deli. Catering orders may require full or partial payment in advance.

Gratuities are optional and are shared among our team.

06 Allergens and dietary needs

Our kitchen handles milk, eggs, fish, shellfish, tree nuts, peanuts, wheat, soy, and sesame. Although we take care to prevent cross-contact, we cannot guarantee that any item is free from allergens. Please tell our team about any allergy or dietary requirement before you order.

Some items can be cooked to order. Consuming raw or undercooked meats, fish, shellfish, or eggs may increase your risk of food-borne illness, especially if you have certain medical conditions.

07 Refunds and complaints

If something is not right with your order, please let us know as soon as possible, ideally before leaving the deli or within 24 hours for catering. We will offer a replacement, credit, or refund where an item is incorrect, missing, or not of acceptable quality.

08 Using this website

You may use this website for personal, non-commercial purposes. You must not:

Use the website in a way that breaks any law or infringes anyone’s rights.
Attempt to gain unauthorized access to the website, its servers, or connected systems.
Introduce viruses, malicious code, or automated tools that place an unreasonable load on the website.
Submit false, misleading, or abusive information through our forms.

09 Intellectual property

The Seaside name, logo, photography, menu descriptions, and website design are owned by or licensed to us. You may not copy, reproduce, or reuse them without our written permission, except to share links to our pages.

10 Third-party links and reviews

Our website links to third-party services such as social networks and review platforms. We do not control these services and are not responsible for their content or privacy practices. Your use of them is governed by their own terms.

11 Disclaimers and limitation of liability

We work to keep this website accurate and available, but we provide it “as is” and do not guarantee that it will always be complete, current, or free from errors or interruptions.

To the fullest extent permitted by law, we are not liable for any indirect or consequential loss arising from your use of the website. Nothing in these terms limits liability that cannot be limited by law, including liability for death or personal injury caused by negligence.

12 Governing law

These terms are governed by the laws of the State of New York. Any dispute will be handled by the courts located in New York, unless the law requires otherwise.

13 Changes to these terms

We may update these terms from time to time. The “last updated” date at the top of this page shows when they last changed. Continuing to use the website after an update means you accept the revised terms.
